Supreme Court for irreparable harm\u00a0\u00a0"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><em><em>Joint Statement from the Harm Reduction Nurses Association, the Canadian Drug Policy Coalition and Pivot Legal Society<\/em>\u00a0<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200b\u200b<strong>x\u02b7m\u0259\u03b8k\u02b7\u0259y\u0313\u0259m, s\u1e35wx\u0331w\u00fa7mesh &amp; s\u0259lilw\u0259ta\u026c <\/strong><strong>lands<\/strong><strong>\u202f<\/strong><strong>Vancouver, BC<\/strong><strong> |<\/strong>\u200b\u202fDecember 20, 2024 \u2013 Yesterday the B.C. provincial government repealed <a href=\"https:\/\/news.gov.bc.ca\/releases\/2024PSSG0093-001673\" target=\"_blank\" rel=\"noreferrer noopener\">Bill 34<\/a>: the <em>Restricting Public Consumption of Illegal Substances Act.<\/em> This represents a small but hard-fought victory against politically-driven laws and policies that inflict harm upon those made most vulnerable by oppressive systems.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <em>Act <\/em>was initially passed last November, but a temporary B.C. Supreme Court <a href=\"https:\/\/drugpolicy.ca\/for-immediate-release-bc-supreme-court-rules-in-favour-of-harm-reduction-nurses-association-pauses-coming-into-force-of-bcs-public-drug-consumption-law\/\" target=\"_blank\" rel=\"noreferrer noopener\">injunction<\/a> filed by the Harm Reduction Nurses Association and supported by the Canadian Drug Policy Coalition and Pivot Legal Society prevented it from coming into force until the court could assess whether it violated Charter rights. Rather than proceed through this process, the province has repealed the legislation.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is important to recognize the harms the <em>Act <\/em>would have codified into law, and the harm prevented by its repeal. In repealing this legislation, the province has tacitly admitted that the <em>Act<\/em> would not have withstood the court\u2019s scrutiny of its harmful consequences. We can count this as a victory. But ultimately, until evidence and ethics guide public policy in B.C., we fear we will be forced to continue these fights.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In its injunction ruling, the court agreed that in severely restricting public drug consumption, the <em>Act<\/em> would cause irreparable harm to people at risk of injury and death amid a public health crisis. Chief Justice Hinkson said, <strong>\u201cGiven the evidence before me, I find that there is a high degree of probability that at least some of the harm set out by the plaintiff will in fact occur. Centrally, but not exclusively, the Act will promote more lone drug use, which carries incumbent risks to [people who use drugs] and also the plaintiff\u2019s members.\u201d<\/strong>&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This piece of legislation, which was not time-limited to the duration of B.C.&#8217;s decriminalization pilot, would also have enabled an increase in policing scope to specifically target unhoused people. The law would have had outsized impacts on Indigenous and racialized people, recreating and intensifying the existing harms of colonization and systemic racism. There was widespread opposition to the <em>Act<\/em>, including from the <a href=\"https:\/\/www.ubcic.bc.ca\/ubcic_demands_drastic_increase_to_harm_reduction_housing_and_treatment\" target=\"_blank\" rel=\"noreferrer noopener\">Union of British Columbia Indian Chiefs<\/a>, the <a href=\"https:\/\/sudu.ca\/blog-3-1\/bill34\" target=\"_blank\" rel=\"noreferrer noopener\">Surrey Union of Drug <\/a><a href=\"https:\/\/sudu.ca\/blog-3-1\/bill34\" target=\"_blank\" rel=\"noreferrer noopener\">Users<\/a>, the <a href=\"https:\/\/bcasw.org\/BCSocial\/Assets\/Documents\/News\/2023%20news\/10_bcasw_bill_34_oct_10_2023_web.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">BC Association of Social Workers<\/a> and <a href=\"https:\/\/bc.cmha.ca\/news\/the-toxic-drug-crisis-bill34\/\" target=\"_blank\" rel=\"noreferrer noopener\">CMHA BC<\/a>.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Though the BC government has repealed Bill 34 in light of the court injunction and significant community backlash, some of the <em>Act\u2019s<\/em> insidious elements exist within the province\u2019s Apr. 2024 <a href=\"https:\/\/drugpolicy.ca\/for-immediate-release-province-moves-to-circumvent-b-c-supreme-court-harm-reduction-nurses-slam-recipe-for-preventable-death\/\" target=\"_blank\" rel=\"noreferrer noopener\">amendment<\/a> to the decriminalization pilot. This politically-driven amendment circumvented the injunction against the <em>Act<\/em> and codified some of its most harmful facets through other means. We stand by our colleagues who have filed a <a href=\"https:\/\/www.cbc.ca\/news\/canada\/british-columbia\/bc-drug-recriminalization-court-case-1.7240629\" target=\"_blank\" rel=\"noreferrer noopener\">judicial review<\/a> of this egregious sidestepping of justice.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While the end of this harmful legislation represents a win for human rights, we continue to exist within a prolonged public health emergency. Criminalizing drug use is a far downstream intervention that lacks evidentiary support. More than a century of criminalization has demonstrated that <a href=\"https:\/\/www2.gov.bc.ca\/assets\/gov\/health\/about-bc-s-health-care-system\/office-of-the-provincial-health-officer\/reports-publications\/special-reports\/stopping-the-harm-report.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">enforcement<\/a> has not decreased drug availability or use, is an ineffective use of public funds, and is clearly linked to an increased risk of <a href=\"https:\/\/www.cmajopen.ca\/content\/9\/3\/E907\" target=\"_blank\" rel=\"noreferrer noopener\">overdose<\/a> and cycles of <a href=\"https:\/\/www.sciencedirect.com\/science\/article\/abs\/pii\/S0277953623002435\" target=\"_blank\" rel=\"noreferrer noopener\">homelessness<\/a>. Criminalization drives further toxicity and unpredictability in the unregulated drug supply and signals to a significant portion of B.C.\u2019s population that their deaths are acceptable. Once again, Chief Justice Hinkson reminds us, <strong>\u201cI have already set out that British Columbia is in a Public Health Emergency. As part of these circumstances, the plaintiff argued, and I accept, that the unregulated nature of the illegal drug supply is the predominant cause of increasing death rates in British Columbia.\u201d<\/strong>&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We know the drivers of more than <a href=\"https:\/\/app.powerbi.com\/view?r=eyJrIjoiM2Y5YzRjNzQtMzAyNS00NWFiLWI3MDktMzI5NWQ3YmVhNmZjIiwidCI6IjZmZGI1MjAwLTNkMGQtNGE4YS1iMDM2LWQzNjg1ZTM1OWFkYyJ9\" target=\"_blank\" rel=\"noreferrer noopener\">five preventable deaths<\/a> per day in B.C.: stigma, isolation, and a poisoned drug supply. All three are made worse by criminalization.
